Intellectual Property Complaint Policy

PrideIsHere provides creators and communities with a platform to sell custom apparel, accessories, and home décor. All users must agree to our Terms of Service before using our platform. As part of this agreement, users are strictly prohibited from listing or selling products that infringe upon third-party intellectual property rights, including but not limited to copyright, trademark, trade dress, and rights of publicity.

Our policy is to promptly remove any content reported in good faith as infringing on intellectual property rights and to take action against repeat violators, up to and including account termination.


Reporting Intellectual Property Infringement

If you believe that your intellectual property rights have been violated by a PrideIsHere user, please email us at support@prideishere.com with the following information:

  1. A physical or electronic signature of the person authorized to act on behalf of the rights owner.

  2. The URL(s) of the campaign(s) selling the allegedly infringing products.

  3. Identification of the intellectual property allegedly infringed (e.g., trademark, copyright), including proof of ownership.

  4. Your full legal name, address, telephone number, and email address.

  5. A statement of good-faith belief that the reported use is not authorized under applicable law.

  6. A statement, under penalty of perjury, that the information provided is accurate and that you are authorized to act on behalf of the rights owner.


Counter-Notice Policy

If you believe that a takedown notice was submitted in error or due to misidentification, you may file a counter-notice. Please note: submitting a false claim of non-infringement may result in legal consequences. If you are unsure, consult an attorney before proceeding.

Send your counter-notice to support@prideishere.com and include the following:

  1. Your physical or electronic signature.

  2. Your full legal name, address, phone number, and email address.

  3. Identification of the material removed (URL or campaign ID) and its location prior to removal.

  4. A statement, under penalty of perjury, that the removal was a mistake or misidentification.

  5. Your consent to jurisdiction in the appropriate U.S. federal court, and agreement to accept legal service from the complaining party or their authorized agent.

Once a valid counter-notice is received, PrideIsHere may notify the original claimant. Unless the claimant initiates legal action within 10 business days, the removed material may be restored within 10–14 business days.


Repeat Infringement Policy

PrideIsHere monitors repeat intellectual property violations. Accounts that receive multiple infringement claims may be suspended or permanently terminated.

Accounts that violate our Terms of Service or the spirit of our policies may also be subject to termination, even without multiple strikes.
